Please read the following section carefully as it contains the legal terms and conditions that you agree to when you use this web site (tyres.greenflag.com ) to purchase goods and services ("the Site").

The Site is operated by Net Driver Limited (Registered Number 11881732), whose registered address is 1st Floor Enterprise House 202-206 Linthorpe Road, Middlesbrough, United Kingdom, TS1 3QW, under licence from Green Flag Limited (registered number 1003081), whose registered address is at The Wharf, Neville Street, Leeds LS1 4AZ. Net Driver Limited is referred to in these terms and conditions as "NDL", "us" or "we". 

These terms and conditions are between you and NDL. If this is not agreeable to you, then you should not use our service.

These terms and conditions are for the sale of tyres and tyre fitting services.

The ‘Contract’ is for the purchase and sale of the Goods and provision of the Fully Fitted Service as constituted and evidenced by the Customer's Order and the Order Confirmation.
When purchasing the Goods and the Fully Fitted Service through this website your contract is with Net Driver Ltd. Goods sold on the Site are manufactured and supplied by third parties. NDL will use third party service providers to fulfil its tyre fitting obligations under this contract.
If you place an order to purchase Goods through the Site (“your Order”), your Order is an offer to NDL to buy the Goods selected and included in your Order. When you place an Order to purchase tyres, we will send you an e-mail confirming receipt of your Order, this email will be sent by tyres@greenflagretail.co.uk. Your confirmation e-mail is acknowledgement that we have received your Order and your offer to buy the Good(s) ordered. Without affecting your right of withdrawal, you can cancel your Order for Goods by following the cancellation/returns process detailed below.

The Customer's Order shall not be deemed to be accepted by NDL unless and until the Order Confirmation has been issued to the Customer.
As with the Sale of Goods Act, under the Consumer Rights Act, all products must be of satisfactory quality, fit for purpose and as described. The goods supplied to you must match any description given to you, or any models or samples shown to you at the time of fitting. 
The Customer shall be responsible to NDL for ensuring the accuracy of the terms of the Customer's Order submitted by the Customer, and for giving NDL any necessary information relating to the Goods within a sufficient time to enable NDL to perform the Contract in accordance with its terms.  NDL shall incur no liability resulting from inaccurate information being supplied by the Customer.
You need to ensure that you can receive e-mails from us, and we recommend you add tyres@greenflagretail.co.uk to your 'safe sender' list and you may also want to check that your online security software does not block e-mails from our email address. Should you not receive an email confirming your Order, please contact us so we can investigate and ensure your order has been placed.

'Customer' means the person who has made an offer to purchase the Goods and the Fully Fitted Services

'Customer's Order' means an order from the Customer submitted to NDL through the Site by completion of the ordering process through submission of forms as directed on the Site.

'Fully Fitted Service' means the service arranged by NDL for the fitting of the Goods to Customers' vehicles using third party service providers.

'Goods' means the tyres which NDL is to supply in accordance with these Conditions.
'Order Confirmation' means confirmation sent in e mail by NDL of acceptance of the Customer's Order which is issued prior to supply of the Goods and the Fully Fitted Service to the Customer.

Your Order

The Customer shall be obliged to pay the price of the Goods (including VAT) at the price quoted in the sale confirmation on the day of the fitting appointment to the selected Fitting Centre. 
The time of payment of the price shall be of the basis of the Contract.  

Receipts for payment will be issued by the Fitting Centre.

If payment is declined or not authorised by the issuer of the Customer's credit/debit card when processed then, without prejudice to any other right or remedy available to NDL or its Fitting Centre, NDL shall deem the order and contract to be invalidated by the customer.
Goods and Fully Fitted Service Information

Unless expressly indicated otherwise, we are not the manufacturer of the products sold on the Site.  All information about the Goods on the Site is provided for information purposes only and we would recommend that you do not rely solely on the information presented on the Site. 

The Fully Fitted Service is the replacement of new tyres onto vehicle, the addition of replacement valve, wheel tracking, new tyre balancing and disposal of old tyre.
Prices & Availability

Every effort is made for Goods featured on our Site to be available. However, if due to an error one of our products is out of stock or unavailable for whatever reason, we reserve the right to cancel the Order and will inform you of such and arrange an appropriate refund or recommend an alternative product to you.
We try and ensure that all our prices on the Site are accurate, although occasionally some prices may be incorrectly listed. Should we discover an error in the pricing of the goods you have ordered, we will inform you as quickly as possible and offer you the goods at the correct price.
Unless there is an error in pricing, the price that you pay for the Goods will be those ruling at the date of purchase of the Goods.
Prices are listed in pound sterling and are inclusive of VAT.  NDL shall sell and the Customer shall purchase the Goods in accordance with the Customer's Order and Order Confirmation.

Whilst every effort is made by NDL to ensure no such error or omission occurs, any typographical, clerical or other error or omission in website text, acceptance of offer, invoice or other document or information issued by NDL shall be subject to correction without any liability on the part of NDL. 

The quantity, quality and description of and any specification for the Goods shall be those selected by the customer on the Site, displayed at the Site checkout prior to order submission and confirmed in the Order Confirmation.
Fully Fitted Service 

The Goods are fitted to the Customer's vehicle by the fitting centre specified in the Order Confirmation.

Any dates quoted for fitting of the Goods are approximate only and not guaranteed and NDL shall not be liable for any delay in delivery and/or fitting of the Goods howsoever caused.  Time for delivery or fitting shall not be considered within the Contract. Any delay beyond 14 working days will be advised to the customer and if requested a full refund offered.  

If the Customer fails to take delivery of the Goods within 14 days of purchase then, without prejudice to any other right or remedy available to NDL, NDL will return the Goods to the supplier and charge the Customer for any costs incurred as a result of such return.
Risk and transfer of ownership
Risk of damage to or loss of the Goods shall pass to the Customer at the time when the Customer collects the Goods from the Fitting Centre.

This section sets out your rights to return an item, or cancel an order under defined circumstances:

You can cancel your order within 14 days of the Confirmation Order (cooling-off period) 
To notify us of your intent to cancel your contract please call our Customer Services on 0800 193 4191, our lines are open from 9am to 6pm Monday to Friday and 9am to 12pm Saturday or by emailing tyres@greenflagretail.co.uk 
We will refund the cost of your contract, within 14 days of receiving your cancellation 
For more information on your right to withdraw from your purchase during the  cooling-off period, visit the Department of Trade and Industry's website at: https://www.gov.uk/accepting-returns-and-giving-refunds or any equivalent consumer protection authority website in any jurisdiction in which the Customer is resident
Faulty or damaged goods and non-satisfactory service

Please notify us if the service of the tyres being fitted is not of satisfactory standard as soon as you become aware there is a problem, or if any goods you have received from us is faulty or damaged. If the goods is not of satisfactory standard, you have the right to get a full refund, if you notify us within 30 days.  If you tell us after 30 days, we can elect whether to repair the goods or give you a refund.

If you notify us of a non-satisfactory fitting service, we will have this investigated by the fitting centre or if appropriate an alternative NDL fitting centre convenient to you. Depending on the outcome of such inspection, we will elect whether to repair, replace or correct the fault or offer a discount or full refund.

Amendment of the Terms and Conditions

We reserve the right to amend these terms and conditions and any other terms and conditions on this Site without notice to you from time to time. Any such amendment shall be effective once the revised terms have been posted on this Site. As these terms and conditions may be updated from time to time, we suggest that you check them whenever you visit the Site.
Complaints Procedure

In the first instance, you need to let us know. We will always aim to provide you with a superb online service. However, there may be times when you feel that we have not done so. If this is the case, we would rather be told about it so that we can do our best to solve the problem. If you have a complaint, then please contact us and we will make sure that your complaint is considered immediately.

The UK European Consumer Centre, delivered by the Chartered Trading Standards Institute, provides further advice regarding online dispute resolution.
NDL shall have no liability for errors in any Customer's Order and any loss (or otherwise) that may arise therefrom.

NDL shall be under no liability in respect of any defect in the Goods arising from fair wear and tear, wilful damage, negligence, abnormal working conditions.
Where NDL is the subject of any claim regarding damage caused to the vehicle or wheels during the Fully Fitted Service, the NDL fitter must be given the opportunity to inspect and rectify the claimed damage.
